State COA to Hear Facebook

ALBANY, N.Y. – Facebook is taking its fight over digital privacy to the state’s highest court Tuesday.

The company is challenging search warrants from Manhattan prosecutors who sought the account information of more than 380 people in 2013.

The prosecutors were investigating a disability benefits fraud case against police and fire retirees at the time.

Lower courts sided with the Manhattan District Attorney, saying it was up to individual users to fight the warrants.

But Facebook insists it has the right to challenge warrants for information about its users.

Oral arguments before the Court of Appeals in Albany are set for Tuesday afternoon.
