Congressman Engel: My Constitutional Amendment to Fix Our Elections

We live in the greatest democracy in the world, but after 240 plus years I feel a good portion of our electoral system could use an upgrade.

That’s why I’ve introduced H.J. Res. 28, a Constitutional Amendment to improve and make fairer our elections.

Even without foreign entities nosing into our democratic process, the United States trails most developed countries in political engagement and voter turnout. I feel that this comes from longstanding structural issues that we have yet to address. And since the Supreme Court gutted the Voting Rights Act in 2013, we’ve even seen a concerted effort on the part of some people in power to openly make it harder for people to vote.

These attempts to undermine our electoral process cannot stand. Voter suppression, minority disenfranchisement, too much outside money in campaigns, gerrymandering, the woefully outdated electoral college; all of these things detract from our democratic system. So rather than try to fix these things by piecemeal, I’ve introduced a “one-stop shop” for fixing the electoral process.

My Constitutional Amendment would do 6 main things:

(1) repeal the Electoral College.

(2) constitutionalize the Voting Rights Act and enshrine the individual citizen’s right to vote in the Constitution.

(3) give Congress the express power to regulate campaign expenditures and activities from private parties while outlawing foreign interference. This would overturn Citizens United.

(4) outlaw political gerrymandering.

(5) enact automatic universal registration for all American citizens over 18 years of age.

(6) establish Election Day as a national holiday and protect working people from retaliation for taking time off to vote.

Our democracy is at its strongest when everybody participates, and in order to make that happen, we need to revamp the entire system. I will continue to promote a comprehensive Constitutional approach to fixing our elections, while also working tirelessly to ensure foreign entities like Russia are held accountable for their meddling.
