Bronx DA: Former Officers Sentenced for Roles in Attack on Inmate

 

Convictions for Assault on Inmate, Falsifying Reports

(Bronx, NY – January 20, 2016) – Bronx District Attorney Darcel D. Clark announces the sentencing of former Rikers Island Correction Officers VICTOR RODMAN and MICHELLE HUBERT in connection with the assault on an inmate that caused the man to permanently lose the sight in one eye.

 

Today, Bronx Supreme Court Justice Martin Marcus sentenced the 53-year-old VICTOR RODMAN to 90 days in jail, to be served on the weekends, along with 250 hours of community service and a three-year conditional discharge. This followed his conviction in a non-jury trial last year for:

 

Falsifying Business Records in the 1st Degree (2 counts, Class E Felony)

Assault in the 3rd Degree (Class A Misdemeanor)

 

 

Last week, Justice Marcus granted the 47-year-old HUBERT a three-year conditional discharge, with the condition of 200 hours community service.  She was tried along with RODMAN and found guilty of Falsifying Business Records in the 1st Degree (3 counts, Class E Felony).

 

On July 8, 2009, then-C.O. RODMAN was visiting then-C.O. HUBERT in the George R. Vierno Center’s Building 19 “bubble,” the control center that sits between two wings of the housing unit.       After a fight broke out between inmate Carlos Sanchez and another inmate, Sanchez found himself alone with RODMAN in the vestibule area of Building 19. RODMAN struck Sanchez once in the face, causing a broken nose, and permanent loss of vision in his left eye.

 

Subsequently, RODMAN and HUBERT attempted to cover up the assault as well as RODMAN’s presence in the building by claiming in reports that then C.O. RODMAN was not there.  Eyewitness testimony and surveillance video contradicted their accounts.

 

VICTOR RODMAN, a Correction Officer since 1987, had been suspended without pay, but resigned from his job after being indicted.    MICHELLE HUBERT, who joined the Department of Correction in 2006, was also suspended without pay and fired following her conviction.

 

The case against RODMAN and HUBERT was prosecuted by Assistant District Attorneys Peter O. Kennedy, Vladimir Kocheulov, and Ann Lee of the Bronx D.A. Rackets Bureau.
